6 Tips for Protecting Your Business from Lawsuits

September 13, 2020

6 tips for protecting your business from lawsuits

Starting a business is hard work. There are a million things to consider before you open your doors. Unfortunately, you’ll have to add one more if you haven’t thought about it already: protecting your business from lawsuits.

Starting your new business the right way includes keeping it safe from potentially very costly legal issues. Keep reading for some tips on how to avoid getting sued in the first place.

1. Protecting Your Business Through Insurance

You have insurance for all the important parts of your life. Your car insurance, homeowner’s (or renter’s) insurance, life insurance, and health insurance all help to protect you and your family from huge financial loss.

You should also purchase insurance with coverage for your business in case you get sued. This coverage would pay for legal assistance and even legal damages if you’re convicted.

Even if you don’t plan on doing anything that you would expect to get sued for, it is worthwhile to purchase an insurance policy. In the unlikely event that you do get sued for a large amount of money, you can avoid it destroying what you’ve worked to create.

2. Write and Follow Your Own Policies and Guidelines

Each business and industry has its own legal concerns and safety issues. Whatever your business’s vulnerabilities are, write out policies that will be used to mitigate those risks.

Having written company policies and procedures makes it much easier for owners and employees to stick to the best and safest practices. They won’t be as tempted to make costly mistakes in the name of convenience.

Having policies in place will also provide some evidence and documentation that you are not negligent if you are indeed sued.

3. Act Honestly and Professionally

If your customers like and trust you, it’s much less likely that they would cause legal trouble. It pays to act in a trustworthy, professional, and friendly manner.

This is not to say that circumstances arise that will still lead to legal issues, but one of the simplest and most effective ways to avoid it int he first place is by being honest and straightforward in all your dealings.

4. Get a Lawyer

It is essential that you get good legal representation for your business. This should be done as soon as you start your business, but certainly, if you get sued. You will need their expertise.

5. Make Your Property Safe

Take the time to clear ice and snow. Make sure the fire alarm works. Fix the broken stairway. Think ahead to anything that could injure someone and cause them to sue you and take care of it in advance.

6. Utilize Professional Assistance

If you do end up being sued, contact your lawyer and insurance companies immediately to get their advice. If you have to pay out damages, your lawyer can help you navigate the next steps.

There are companies such as https://www.rightwayfunding.com/structured-settlements that offer structured settlement payout options for the person who is owed money. Your lawyers can help you negotiate with them.

Plan Ahead Avoid Legal Trouble

Taking these basic steps will greatly reduce the chance of your business being sued for damages. Don’t wait until it’s too late, though. Make planning for future legal issues a part of your initial business plan.

Protecting your business with insurance, written policies, legal assistance, and honest practices will help you be as successful as possible.
